Welcome to MindGuide, operated by MyMindGuide Limited (“MindGuide”, “us”, “we”, “our” and the “Company”). We are registered in England and Wales under company number 14036098 and have our registered office at 59 The Grange, London, England, SE1 3GU.
By accessing or using our services on https://app.mindguide.uk/, or any other platforms or services MindGuide may offer (collectively, the “Platform” or our “Platforms”), you agree to, and are bound by the Terms and Conditions (the “Agreement”) which govern your access to and use of our Platforms.
The Agreement applies to anyone who accesses or uses our Platforms, regardless of registration or subscription status. If you do not agree to be bound to any term of this Agreement, you must not access our Platforms. If you access it via another website or application operated by a third party, we do not accept any responsibility for the acts and omissions of that third party.
Our services
We offer the following services:

WE ARE NOT A CRISIS OR EMERGENCY SUPPORT SERVICE. IF YOU NEED URGENT SUPPORT, PLEASE USE THESE RESOURCES TO GET IMMEDIATE HELP INSTEAD.
Our self-help content has been developed by mental health industry experts using evidence-based research and best practices but we are unable to guarantee that it is relevant to you and up-to-date.
The Agreement assumes that you are UK resident, over 18, have an email address, and have access to the internet. If you are not a UK resident we cannot guarantee that our content and/or services are compliant in the jurisdiction in which you are resident.
We reserve the right to remove you from or deny you access from our Platforms and to delete your account.
Our content
Content on our Platforms is not medical advice. It is lifestyle advice for the advancement or protection of your mental wellbeing and health. You should always seek appropriate medical advice before taking, or refraining from, any action on the basis of the content on our Platforms.
Whilst we are confident in the quality of our self-help content, we give no guarantee that your sessions and information on our Platforms will help you achieve your goals or protect you from harm.
We may update and change our Platforms from time to time and do not guarantee that our Platforms, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our Platforms for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.
Although we make reasonable efforts to update the information on our Platforms, we make no representations, warranties or guarantees, whether express or implied, that the content on our Platforms is accurate, complete or up-to-date.
You are also responsible for ensuring that all persons who access our Platforms through your internet connection are aware of these terms and other applicable terms and conditions, and that they comply with them.
How you may use our content
We are the owner or the licensee of all intellectual property rights in our Platforms, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
You may print off one copy, and may download extracts, of any page(s) from our Platforms for your personal use and you may draw the attention of others within your organisation to content posted on our Platforms.
You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
Our status (and that of any identified contributors) as the authors of content on our Platforms must always be acknowledged (except where the content is user-generated).
You must not use any part of the content on our Platforms for commercial purposes without obtaining a licence to do so from us or our licensors.
Uploading content to our Platforms
Whenever you make use of a feature that allows you to upload content to our Platforms, or to make contact with other users of our Platforms, you must comply with the content standards set out in our Acceptable Use Policy.
You retain all of your ownership rights in your content, but you are required to grant us a limited licence to use, store and copy that content and to distribute and make it available to third parties in order to provide our services to you.
We have the right to remove any posting you make on our Platforms if, in our opinion, your post does not comply with the content standards set out in our Acceptable Use Policy.
You are solely responsible for securing and backing up your content.
We do not store terrorist content.
No text or data mining, or web scraping
You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to our Platforms or any services provided via, or in relation to, our Platforms. This includes using (or permitting, authorising or attempting the use of):
Any "robot", "bot", "spider", "scraper" or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of our Platforms or any data, content, information or services accessed via the same.
Any automated analytical technique aimed at analysing text and data in digital form to generate information which includes but is not limited to patterns, trends and correlations.
The provisions in this clause should be treated as an express reservation of our rights in this regard, including for the purposes of Article 4(3) of Digital Copyright Directive ((EU) 2019/790).
This clause shall not apply insofar as (but only to the extent that) we are unable to exclude or limit text or data mining or web scraping activity by contract under the laws which are applicable to us.
Privacy and security
You need to register at our Platforms to access self-help content. We are required to collect some personal information about you in order for us to work with you safely and effectively. You cannot start self-help content until we have these details.
Protecting and safeguarding any information you provide through our Platforms is extremely important to us. Please refer to our Privacy Policy for more information.
By agreeing to these terms and/or by using our Platforms, you are also agreeing to the terms of the Privacy Policy. The Privacy Policy is incorporated into and forms part of this Agreement.
If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.
We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms.
If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at admin@mindguide.uk.
Technical difficulties
Sometimes we might have to suspend our Platforms to deal with technical problems or make minor technical changes. These suspensions should be brief but we will not be liable for any such periods of suspended service, or any losses incurred by you as a result of the suspension, irrespective of the length of that suspension.
We will not issue any refund if you are not able to use our Platforms because of technical issues with your equipment or your internet connection.
Communication
We may provide notices or other communications to you regarding this agreement or any aspect of our Platforms, by email to the email address that we have on record. The date of receipt shall be deemed the date on which such notice is given. Notices sent to us must be delivered by email to admin@mindguide.uk. It is your responsibility to keep your contact details up-to-date.
You must not introduce material that is malicious or technically harmful onto our Platforms
You are responsible for configuring your information technology, computer programmes and platform to access our Platforms. You should use your own virus protection software.
You must not misuse our Platforms by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Platforms, the server on which our Platforms is stored or any server, computer or database connected to our Platforms. You must not attack our Platforms via a denial-of-service attack or a distributed denial-of service attack.
By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Platforms will cease immediately.
Rules about linking to our Platforms
You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
You must not establish a link to our Platforms in any website that is not owned by you.
Our Platforms must not be framed on any other site, nor may you create a link to any part of our Platforms other than the home page.
We reserve the right to withdraw linking permission without notice.
The website in which you are linking must comply in all respects with the content standards set out in our Acceptable Use Policy.

Other important information
This contract is between you and us. It is private and no one else has any rights to enforce its terms. We have the right to change or amend the terms of this contract at any time, however we will notify you of such changes by way of updates to these terms on our Platforms. It is your responsibility to regularly check these terms and make yourself aware of any changes.
Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
